are class action lawsuits unheard of against major media?
if people did the right sort of lawsuit things could get really embarassing really quickly:
as in  -- anyone attempting to cover it up would create an effect not unlike Tipper Gore
 did when she started forcing parental guidance stickers on controversial lyric artists.
 every time a band had those stickers on, sales skyrocketed.

so the idea...if there were a class action lawsuit against Bill O' Reilly and Glen Beck
 for not reporting about this -- it would have to come out.  MSNBC and CNN would have
 to decide if they, too would ignore the story -- or if all three sold-out propaganda organizations
 would band together in protecting fracking Halliburton...

because i do believe that hydraulic fracturing is being planned for other sites as we speak.
if people get disgusted and sue the propaganda outlets -- and the journalists themselves,
not their powerful bosses, but the talking heads...

anyway:

If hydraulic fracturing is so safe, why does Halliburton need indemnification?

Is it just me, or does this indemnification language blow holes in industry's mantra about how safe hydraulic fracturing is?

C. RELEASE AND INDEMNITY Customer [(Texas Keystone)] agrees to RELEASE Halliburton Group from any and all liability for any and all damages whatsoever to property of any kind owned by, in the possession of, or leased by Customer and those persons and entities Customer has the ability to bind by contract or which are co-interest owners or joint venturers with Customer. Customer also agrees to DEFEND, INDEMNIFY AND HOLD Halliburton Group HARMLESS from and against any and all liability, claims, costs, expenses, attorney fees and damages whatsoever for personal injury, illness, death, property damages and loss resulting from: loss of well control, services to control a wild well, whether underground or above the surface, reservoir or underground damage, including loss of oil, gas, other mineral substances or water, surface damage arising from underground damage, damage to or loss of the well bore; subsurface trespass or any action in the nature thereof; fire; explosion; subsurface pressure; radioactivity; and pollution and contamination and its cleanup and control.
I'm not a lawyer but here's how I translate this language:
  1. frack happens.
  2. We admit frack happens and that we loose control of frack.
  3. When frack happens
    • people could die
    • public property could be damaged
    • public mineral property could be damaged
    • private property could be damaged from a fracking trespass
    • There could be fire, explosions, radioactivity, etc.
    • It can cause pollution and contamination.

I've asked this before but it bears repeating:

If hydraulic fracturing -- also known as fracking --  is so damn safe, then why does industry need exemptions/loopholes from our federal environmental laws and why do they need all this indemnification?

Remember that Halliburton was fracking the BP well that is now a river of oil flowing into the ocean. They screwed up on their cementing job, which, according to this white paper, happens often. I've posted before about the cementing jobs.

North America will be facing years of toxic rain becuase of the poisonous chemical dispersants BP is using to control the Gulf of Mexico oil spill.

When you pour more than a million gallons of toxic chemical dispersants on top of an oil spill, it doesn't just disappear. In this case, it moves to the atmosphere, where it will travel hundreds, if not thousands of miles from the site of the BP oil spill, in the form of toxic rain.

BP's oil spill-fighting dispersant of choice is Corexit 9500. It has been banned in Europe for good reason. Corexit 9500 is one of the most environmentally enduring, toxic chemical dispersants ever created to battle an oil spill.  Add to that the millions of gallons of oil that have been burned, releasing even more toxins into the atmosphere, and you have a recipe for something much worse than acid rain.

The European Union Times reports "A dire report prepared for President Medvedev by Russia's Ministry of Natural Resources is warning today that the British Petroleum (BP) oil and gas leak in the Gulf of Mexico is about to become the worst environmental catastrophe in all of human history threatening the entire eastern half of the North American continent with "total destruction".

The reports adds, "Russian scientists are basing their apocalyptic destruction assessment due to BP's use of millions of gallons of the chemical dispersal agent known as Corexit 9500 which is being pumped directly into the leak of this wellhead over a mile under the Gulf of Mexico waters and designed, this report says, to keep hidden from the American public the full, and tragic, extent of this leak that is now estimated to be over 2.9 million gallons a day."

Oil in the environment is toxic at 11 PPM (parts per million). Corexit 9500 is toxic at only 2.61 PPM. But Corexit 9500 has another precarious characteristic; it's reaction to warm water.
                            
As the water in the Gulf of Mexico heats up, Corexit 9500 goes through a molecular transition. It changes from a liquid to a gas, which is readily absorbed by clouds and released as toxic rain. The chemical-laden rain then falls on crops, reservoirs, animals and of course, people.

It is futile to believe that we can keep 'Corexit rain' from occurring since it has already been released and the molecular transformation has begun. We have set off an unprecedented chain of events in nature that we cannot control.

By releasing Pandora's well from the depths and allowing it bleed into the sea the unimaginable becomes material.

Yet unlike a bad dream, we will not wake up from this nightmare and find it gone. The BP Gulf of Mexico oil spill will be touching millions of earth's life forms for uncountable years.
